What is Negotiation?

Negotiation services refer to professional assistance provided to individuals, organizations, or groups, in order to help them navigate and conduct constructive dialogue and negotiations. The objective of negotiating is to reach a mutually acceptable agreements and foster healthy communication dynamics.

What are the Benefits to Negotiating

There are many benefits associated with negotiation services;

  1. Minimizing Risk - Using negotiation can help ensure participants are in a structured environment, where there perspective and communications are free of persecution and punishment. Negotiation can be a private and safe space for participants to seek resolution on their own terms.

  2. Skill Development - Our services are designed to help participants learn skills that can be employed in both current and future circumstances; Alternative Decisions seeks to enable users to become self reliant in their negotiating skills.

  3. Program Integration - Our service providers are trained and able to integrate services from other programs we provide. Should negotiations be unsuccessful, mediation and arbitration services can be provided.

What are the Limits to Negotiation?

Although mediation is a flexible, but there are limits to its process and scope.

  1. Voluntary Process - Negotiation relies on the active and voluntary nature of its participants. If participants are unwilling to engage, negotiation may not be possible or effective.

  2. Imbalance of Power - In situations where there is a case of significant power imbalance, negotiation may not be possible.

  3. Complex Legal Issues - Negotiation is not a form of legal counsel; should participants require legal advice or action, negotiation is not an appropriate forum.

  4. Criminality -Negotiation may not be an appropriate service for criminal matters, depending on the scope and nature of the conflict.

  5. Non-binding - Negotiation agreements and their respective outcome(s) are not legally binding; should participants require legal advice or action, Alternative Decisions recommends seeking legal counsel or aid.

What are the steps to Negotiation?

  • There are several steps prior to negotiation sessions taking place.

    Users can expect the following for their service plan, however these are subject to change based on both participant and negotiator needs.


    1. Informational Session (recommend) - We recommend that any potential service users book a complementary info session prior to applying. Book Now

    2. Apply for services - Apply for services; applications may be submitted via a variety of means. Learn More

    3. Intake Session - Once approved, service users may schedule an intake session. This step gives users and negotiator(s) an opportunity to meet 1:1; privately discuss the issue and begin the solution drafting process. Book Now

    Users should also expect to submit the following documents at this time: Agreement to Mediate, Confidentiality Agreement, Conflict of Interest Agreement.

  • 4. Joint or Individual Negotiation Sessions - At this step negotiation sessions involving all participants or select participants. Sessions vary in length of time, suited to the needs of those participating.

    Service users will utilize these sessions for collaborative solution making. Users may end sessions and/or process at any time.

    Schedule these sessions with your negotiator.

  • 5. Solution and Drafts - Once participants achieve a mutually agreed upon solution, a draft agreement, or other documents, may be prepared upon the users request.

    6. Implementation - At this stage participants are expected to uphold any commitments and/or agreements they made.
